If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Adrian Hotter’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use this website.
‘Adrian Hotter’ / ‘Artist’ /’Us” / ‘We’ / ‘I’ refer to the owner of the website whose business address is Parsons Street New Plymouth. The term ‘you’ / ‘Client’ / ‘Customer’ / ‘Collector refers to the user or viewer of this website.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Order Cancellation & Refunds

Portrait Delivery

All commissions are made on a first-come first-served basis and delivery-times depend on my workload at the time you place the order. Contact me to find out how much work I have at this time. Any timelines provided at time of ordering are approximates only and are not guaranteed although every effort will be made to keep to these guidelines.

7-Day Money Back Guarantee (COMMISSIONS ONLY)

We offer a 7-Day Money Back Guarantee on all commission requests. Clients have a 7-day money back guarantee from the date of their order and they will receive a full refund – MINUS BANKING FEES OR CHANGES IN EXCHANGE RATES. This is classed as a cooling off period and no work will begin in this time period.

Cancellation Before Painting Begins – BUT AFTER 7 DAYS

Clients are required to make a 50% deposit to secure a place in our client list – If clients wish to cancel prior to artwork starting, but once works begins, the deposit is retained to cover fees, materials, office administration, preliminary mockups, website client list creation and client emails.

Right of Refusal

In the event that the Client does not wish to purchase the finished commissioned artwork, the Client may refuse. In that case, the Artist will retain the refused artwork and the deposit. This is free of any claims or interests of the Client and the Client will not owe any additional fees to the Artist. Once paid for in full the Client waives this right.

Rejection of Portrait Once Shipped

We are unable to refund paintings that are personally and specifically designed for a customer. All paintings will be of the same standard as shown on the website which show examples of our works. I aim to please so I will work to ensure the client is happy with the end result. Once you have approved the portrait at photo stage and final payment made, we cannot offer further alterations and no returns or refund will be made.

Damage in Transit

Always check the package for possible damage before accepting your delivery. We pack our paintings to a very high standard, however in the unlikely event your painting is damaged, please photograph the packaging and artwork and email us immediately. The artwork is to be returned to us in its original packaging at the clients cost. Once received we will repaint or redraw the painting at no further cost. The lead-time will depend on our client list at that time.

Reproduction Rights

Any commissioned artwork I create is for personal use only and cannot be used for financial gain. I own the reproduction copyright on all my artwork. No reproductions are to be made without my express permission.

PRINTS & ORIGINALS

Order Cancellation & Refunds

We offer a 30 day money back guarantee on all non-commission artworks / prints / merchandise – MINUS BANK FEES AND EXCHANGE RATE DIFFERENCES.

To be eligible for a refund, your item must be returned in the same condition that you received it.  Email us to request a refund.

Non-refundable items:

  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery
  • Gift Certiticates
  • Shipping Costs
  • Import Tax

Shipping Times

Shipping times are subject to the courier used. We do not guarantee shipping times and cannot be held responsible if expectations are not reached. The Client will be provided with a tracking number to keep an eye on the progress of the shipment.

Currency Exchange

Prices are quoted in NZ Dollars. Our prices can be seen on our prices page. If you reside outside of NZ, your chosen payment gateway should exchange the amount charged to the currency of your country at the current rate. Please note we cannot be held responsible for any loss due to exchange rate fluctuations.

Taxes & Quarantines

Any additional costs such as Value Added Tax (VAT) / Goods & Services Tax (GST) or quarantine costs remain the responsibility of the Client import to your country.

Gift Vouchers

Gift Vouchers are valid for 2 years and must be redeemed within 2 years of purchase. Gift Vouchers cannot be exchanged for cash. The purchaser’s full name is noted in a database to avoid possible fraud. Ownership of the voucher cannot be changed.
